Mediation and Negotiation
Our expertise covers a variety of mediation processes including family law, and commercial as well as Labour issues. Within family law our primary concern is with the developing of parent plans and contact schedules. In cases of maintenance we have specialists who co-mediate with us
Within the area of commercial and labour issues we can either conduct the mediation itself, or assist in the planning and support of the mediation process.
Martin is an internationally accredited mediator with the ADRg in London as well as being a panelist with Equillore and the African Centre for Dispute Settlement. He is also an accredited member of FAMAC.
Within the field of negotiation, skilled negotiators plan negotiation strategies and assist businesses with the implementation of the strategies, either directly or in a supportive role. In addition, we run courses training appointed individuals in the art of negotiation.
Negotiation practice involves not only what happens at the negotiating table and planning to negotiate at the table but also looking at the broader context and designing the lobbying and structuring the sequencing of negotiations in order to find the best creative solution for both parties with the aim of maintaining relationships between negotiating parties well into the future
We offer a number of services.
Pre-and post divorce coaching.
We offer a specialized course and process with individuals undergoing a divorce in which we assist them to strategies the divorce and develop an expertise in interacting with attorneys and ex-spouses-to-be in an attempt to reduce the conflict between the parties.
This process involves teaching individuals about children’s developmental stages, how to deal with alienation, and how to develop and request an appropriate contact schedule with children. This course will also help you to understand the limits of the various people involved with the divorce and how to negotiate with them.
Our focus is children’s best interests and we offer a specialised evaluation of contact and care issues. We prefer to use a two psychologist team with one psychologist evaluating the personality of the parties and the other, a specialist in child development, evaluating the children. They combined their insights to provide a comprehensive analysis of the individuals and family dynamics with recommendations regarding care and contact as well as what interventions need to be implemented to ensure successful, conflict free co-parenting into the future.
In 2001 Martin, together with Leigh Pettigrew and Adv Janet McCurdy introduced the concept of the Parent Plan Manager which later became known as the facilitator and is now widely used throughout the Western Cape.
In this process a person is appointed by court order who, in the case of disputes in the family has the jurisdiction to make an issue directives which are then binding on the parties.
This is a quick and effective method of resolving disputes between conflicting, divorced couples without them having to revert to the Courts.
Psychotherapy and Coaching
Psychotherapy is the treatment of mental and emotional disturbances and disorders using psychological methods. This type of therapy may last for just a few sessions, or treatment may last for several years, depending on the individual needs of the patient. Psychotherapy may involve just one individual at a time or a group of individuals.
Coaching is a practical intervention aimed at developing the practices and resources necessary to deal with specific and general life challenges. This may include general relationships, work or health, or may involve specific issues within those areas
Although coming from a psychoanalytic and Gestalt therapy background, Martin has been trained in Mentalization Based Therapy and tends to make this his focus. In MBT therapy the focus is on being able to process one’s own thoughts emotions and behaviour while having a mind to those of the other person.
The aim is to develop a more emotionally regulated, emotionally intelligent, empathic and responsive orientation with respect to self and to others.
In his coaching, MBT therapy concatenates with the integrative coaching methods which looks through broader lenses at the issues brought in for coaching.
